General Terms and Conditions of Sale and Shipping
1. Introduction
The commercial relationship between La Boutique della Contessa and its customers is governed exclusively by the following terms and conditions of sale, which supersede and exclude any other previously agreed upon orally.
2. Technical Information
The technical information printed in the catalog is based exclusively on official data published by the manufacturers. We reserve the right to modify technical and dimensional parameters based on information provided by the manufacturers.
3. Orders
Orders will be processed according to customer requests. Any alternatives to the requested product will be provided only after notification to the customer and approval.
Orders from countries outside Italy that are not members of the European Union will be processed only after notification to the customer and approval.
4. Prices
All prices printed in the catalog include VAT. Prices are those in effect at the time the catalog was printed.
We reserve the right to change them without notice based on market price trends and exchange rates between the Euro and other currencies.
5. Shipping and Delivery
All orders received will be shipped via express courier (24-48 hours) to Italy and EU countries.
Shipping costs are calculated based on weight and the delivery location and country.
For European Union countries, shipping costs are calculated by the system based on our shipping agent's rates.
6. Payments
The goods we supply must be paid for according to the customer's chosen method, using one of the following methods:

7. Risk and Ownership
The goods are shipped freight collect (a flat-rate shipping cost is added to the invoice), and therefore the risk passes to the customer upon delivery to the courier. Always check the integrity of the packaging upon receipt of the goods.
8. Right of Withdrawal
As provided for by Article 52 of the Consumer Code (Legislative Decree no. 2006 of 6 September 2005 – last updated on 13 June 2014), the customer, who is a natural person and makes a purchase exceeding €25 (including taxes and additional costs), has the right to withdraw from the contract.

To meet the withdrawal deadline, it is sufficient for you to send the communication relating to the exercise of the right of withdrawal before the withdrawal period expires.
Effects of withdrawal:
If you withdraw from this contract, we will refund all payments received from you, including delivery costs (with the exception of any additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and in any event no later than 14 days from the day on which we are informed of your decision to withdraw from this contract. Such refunds will be made using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any case, you will not incur any fees as a result of such refund. We may withhold the refund until we have received the goods back or until you have supplied evidence of having sent back the goods, whichever is the earliest.
You are requested to return the goods or hand them over to us or to Boutique della Contessa, Via E. Fermi 17, 54100 Massa (MS), without undue delay and in any case within 14 days from the day on which you communicate your withdrawal from this contract. The deadline is met if you return the goods before the 14-day period expires. You will be responsible for the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
9. Request for Return of Goods
The request for return of goods must be submitted to Boutique della Contessa within 14 days of receipt, specifying the reason and citing the purchase invoice reference. Please use the RMA Request Form.
In the event of an error in the order by the customer, any return authorization will be at the sole discretion of Boutique della Contessa. In all cases it is necessary to wait for the communication of the return authorization number, which must be reported on the transport document and
on the outer packaging. The goods must also be shipped within one week of receiving the return number. The goods must be returned intact, complete with accessories, and protected in suitable packaging. Shipping costs are the sole responsibility of the customer. Returned goods without the above requirements will be refused and returned freight collect to the sender.
10. Complaints
Any shipping errors or missing items must be reported promptly to Boutique della Contessa, citing the order number.
11. Liability
Boutique della Contessa, except in cases of willful misconduct or gross negligence, will not be liable for any direct or indirect damage or loss resulting from delayed or failed delivery of the product, or for non-compliance of the goods with the specifications published in the catalog, or for any other cause not attributable to Boutique della Contessa itself.
12. Warranty
La Boutique della Contessa is liable for the "manufacturer's warranty" exclusively in the cases and under the conditions set forth in Presidential Decree No. 224 of May 24, 1988.
In any case, La Boutique della Contessa, as it is not responsible for the production of the goods, will repair any products that may present technical manufacturing defects according to the terms and conditions set forth in the warranty certificate included in the product packaging and issued by the manufacturer. By way of example and not limited to, this clause shall apply with reference to the duration of the warranty period and to cases where the warranty is excluded in the event of tampering or incorrect use of the goods.

13. Jurisdiction
For any dispute, the competent court is the Court of Parma.
